This is an application under Section 438 Cr.P.C. read with Section 482 Cr.P.C. preferred on behalf of the Applicant seeking anticipatory bail in case FIR No.362/2023 dated 29.05.2023 under Sections 394/397/34 IPC and Sections 25/27 of Arms Act, 1959 registered at PS: Rani Bagh. 2.
Status Report has been filed in which it is stated that the Applicant has been declared as a Proclaimed Offender by the Trial Court on 13.12.2023 and therefore the present application is not maintainable in view of the judgment of the Supreme Court in State of Haryana v. Dharamraj, 2023 SCC OnLine SC 1085.

At this stage, learned counsel for the Applicant, on instructions, states that the Applicant shall surrender and apply for regular bail in accordance with law.

The present petition is, therefore, dismissed as not maintainable in view of the aforesaid judgment giving liberty to the Applicant to surrender and take recourse to appropriate remedies available in law. Pending application also stands disposed of.
