% 25.04.2026 The matter has been listed today since 03.03.2026 was declared a holiday.
The parties have settled the matter in mediation.
Settlement Agreement dated 06.02.2026 has been placed on record. Learned counsel for the petitioner seeks disposal of the petition in terms of the settlement. She further seeks reversal of the conviction and the sentencing order.
Learned counsel is present on behalf of respondent No.1 confirming that the matter has been settled and does not oppose the prayer made. The petition is accordingly disposed-of holding the parties bound by the terms of Settlement Agreement dated 06.02.2026. Accordingly, order dated 16.11.2022 passed by the learned Sessions Court in CRL. A. No. 28/2022, order dated 01.12.2022 passed by the learned Sessions Court in CRL. A. conviction dated 09.12.2021; and order on sentence dated 20.12.2021 passed by the learned trial court in CC No.3552/2016 are set-aside. Furthermore, as prayed-for by learned counsel for respondent No.1 the amount of Rs.2,50,000/- deposited with the Registrar General of this court, in compliance of order dated 23.12.2022 (alongwith upto date interest, if any) is directed to be released in favour of respondent No.1 within 02 weeks of the said respondent approaching the Registry for the purpose. The learned trial court is also directed to release in favour of respondent No.1 the amount lying deposited with that court in the present proceedings.
Petition stands disposed-of, in the above terms. Pending applications, if any, also stand disposed-of.
