This hearing has been conducted through hybrid mode. 2.
Learned counsel for the Respondent namely Sh. Kamal Mehta, submits that as the Respondent has received the payment of Rs.64,00,000/- from the Petitioner through a third party, so the Petitioner be directed to file the Board Resolution to that effect authorizing the third party to make the said payment on the behalf of the Petitioner before the Executing Court. 3.
Learned counsel for the parties submit that since the amount has already been paid, appropriate statements shall be made after the filing of the Resolution before the Executing Court, seeking withdrawal of the Execution proceedings as settled.
It is further submitted that the Decree holder/Respondent shall also make a statement before the Executing Court in terms of the Settlement arrived between the parties. 4.
It is submitted that all the afore-said petitions be disposed of as withdrawn. Keeping in view of the submissions made by the learned counsel for the parties, all the three petitions bearing nos. CM(M) 2513/2025, CM(M) 1986/2023 & CONT.CAS(C) 1222/2024 are disposed of as withdrawn.
Pending application(s), if any, also stand disposed of. 5.
