The petitioner is seeking initiation of contempt proceedings against the respondent for the willful breach of the undertaking given in terms of the Memorandum of Understanding [„MoU‟] dated 09.02.2023 approved by the learned Principal Judge, South-East District, Saket Courts, Delhi.

After hearing learned counsels for the parties, it is manifest that the present petition appears to be pre-mature as the time to move a joint application for seeking divorce by mutual consent is yet to expire. Hence, as requested, this petition is allowed to be dismissed as withdrawn without prejudice.
