CRL.M.C. 6179/2024 By way of the present petition filed under section 528 of the Bharatiya Nagarik Suraksha Sanhita 2023, the petitioner seeks quashing of case FIR No. 405/2019 dated 16.11.2019 registered under sections 419/420/120-B of the Indian Penal Code, 1860, chargesheet dated 12.01.2020 and order dated 04.02.2020 taking cognizance. The petitioner was arrested on 16.11.2019 and was admitted to regular bail on 25.01.2020. The petitioner has been undergoing trial ever since.

Mr. Manoj Pant, learned APP appearing for the State submits, that the petitioner has a remedy by way of a revision petition before the learned Sessions Court, if he wishes to impugn the order taking cognizance.

The court is inclined to agree with the submission made by the learned APP. The petition also suffers from gross delay. 5.

The petition is accordingly disposed-of, granting liberty to the petitioner to adopt his legal remedies before the learned Sessions Court, as are available in accordance with law; without expressing any opinion on the merits of the matter.
