This hearing has been done through hybrid mode. I.A. 30002/2024 (seeking recording of the satisfaction of decree) 2.
On 3rd April, 2024 this Court passed a decree interalia directing the Defendant/Applicant- Rakesh Verma to hand over the vacant peaceful possession of the suit property/flat being 'No. D-604, True Friends Cooperative Group Housing Society Ltd., Plot No. 29, Sector - 6, Dwarka, New Delhi' to the Plaintiff on or before 30th September, 2024. The relevant portion of the said order reads as follows:
"9. A decree for possession is granted in favour of the Plaintiff against the Defendant in the following terms: a. The Defendant shall hand over vacant and peaceful possession of the suit property to the Plaintiff on or before 30th September 2024.
b. The Defendant shall pay a sum of Rs.35,000/- per The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
month w.e.f. 1st April, 2024 for use and occupation, apart from the usual electricity charges, water charges and municipal charges. The said amount shall be tendered on or before 10th of every month to the Plaintiff by way of a bank account transfer to the following bank account:- Bank Name: Axis Bank, Vijay Nagar Bangalore. A/c No: 917010065843132 IFSC: UTIB0000468 c. Subject to the above being adhered to, the Plaintiff does not press the relief of mesne profits. If the Defendant does not vacate or does not make the payments in accordance with the present order today, the Plaintiff is permitted to seek revival of the suit qua the claims for mesne profits for unauthorized occupation.
d. Insofar as possession of the suit property is concerned, the Defendant shall be bound by the undertaking given today failing which, the Plaintiff shall be allowed to exercise her remedies in accordance with law including by seeking execution of the decree of possession.
10. The affidavit of undertaking on behalf of the Defendant shall be filed within one week.
11. The suit is decreed in these terms and the same is disposed of. All pending applications, if any, are also disposed of."

In terms of the order dated 3rd April, 2024, the keys of the suit property are stated to have been handed over to the ld. Counsel for the Plaintiff.

The True Friends Co-operative Group Housing Society Ltd. has also issued a 'no-dues' certificate dated 3rd May, 2024, which is attached with the application as 'Document B'. In view thereof, no further orders are called for. There shall be no impediment created in the Plaintiff occupying the said property.
