O R D E R

% 04.02.2025 I.A. 3018/2025 (seeking to bring on record the settlement deed) 1.

This application has been filed on behalf of the plaintiff to bring on record the settlement deed dated 27th December, 2024 (hereinafter "Settlement Deed"), entered into between the plaintiff and the defendants. 2.

For the reasons stated in the application, the Settlement Deed is taken on record.

The application stands disposed of.

I.A. 15079/2023 (under Order XXXIX Rule 2A of CPC) 4.

In view of the settlement arrived at between the parties, the present contempt petition is to be withdrawn subject to the defendants fulfilling their commitment in terms of Clause 1.9 read with Schedule F of the Settlement Deed.

Counsel for the defendants submits that the aforesaid compliance will be made within one (1) week from today.

5.1 The statement of the counsel is taken on record. The defendants shall be bound by the same.

In view of the same, the contempt application is disposed of. CS(COMM) 911/2022 7.

The parties have settled their disputes vide Settlement Deed. The Settlement Deed bears the signatures of the authorised representatives of the plaintiff and defendants no.3 and 4. Defendant no.3 is the Director of the defendant no.1 and the proprietor of the defendant no.2. 8.

Defendant no.3 is present in Court today.

I have perused the terms of the Settlement Deed and find the same to be lawful.

The parties shall remain bound by the terms of the Settlement Deed. 11.

In terms of the settlement, the present suit is decreed in favour of the plaintiff and against the defendants in terms of prayer clauses 66 (a), 66(b) and 66(c) of the plaint.

12.

The Settlement Deed shall form part of the decree. 13.

Decree sheet be drawn in above terms.
