The present petition has been filed under Article 227 of Constitution of India by Union of India.

The petitioner is aggrieved by dismissal of their objection petition filed under Section 34 of Arbitration and Conciliation Act, 1996. Said petition was taken up by the learned District Judge on 20.04.2024 and keeping in mind the previous conduct of the petitioner, it was dismissed for non prosecution and in default.

Aggrieved by the abovesaid order, the petitioner filed an application under Order IX Rule 9 CPC and such application has also been dismissed by the learned District Judge on 15.10.2024.

of order XLIII Rule 1(c) CPC and after hearing arguments for some time, learned counsel for petitioner seeks to withdraw the present petition with liberty to file appropriate appeal along with an application seeking condonation of delay in lodging such proposed appeal. 5.
In view of the above, without expressing any opinion with respect to the merits of the case, the present petition is disposed of as not pressed. 6.
Liberty, as prayed, is granted.
