In view of the statements made by the said defendant nos.1 and 2, especially in paragraph 3 of the said respective affidavits, learned counsel for the plaintiff, who has already received both affidavits in advance, seeks to withdraw the present suit.

The suit is accordingly dismissed as withdrawn alongwith the pending applications.
