On the objection of the learned counsel for the defendant no.1 that the present suit is not maintainable as the plaintiff has not instituted the pre-institution mediation before filing the present Suit, the learned counsel for the plaintiffs prays for leave to withdraw the present suit with liberty to file afresh in case the mediation proceedings between the plaintiffs and the defendants fails. 2.

In view the above submission, the suit and pending applications are dismissed as withdrawn with liberty as prayed for. 3.
