At the very outset, Mr. Himanshu Chauhan, learned counsel for petitioner submits that order impugned before this Court is appealable in terms of Order XLIII Rule 1 (r) CPC and, therefore, he seeks to withdraw the present petition which has been filed under Article 227 of the Constitution of India with liberty to seek appropriate judicial remedy as permissible under law.

In view of the above, present petition is disposed of as not pressed. 3.
Liberty, as prayed for, is granted.
