Petition under Section 378(4) Cr.P.C./419 B.N.S.S. has been filed to challenge the judgment dated 28.04.2025 of learned JMFC in Complaint Case No. 1856/2021 under Section 138 NI Act whereby the Complaint under Section 138 NI Act filed by the Petitioner has been dismissed and the Respondent has been acquitted.

In the light of the judgment of Apex Court in Celestium Financial vs. A. Gnanasekaran, 2025 SCC OnLine SC 1320, the Petition alongwith pending Application, is disposed of with liberty to file it before the Court of Sessions, in accordance with law.
