This is a writ petition filed under Articles 226 and 227 of the Constitution of India seeking cancellation of sale certificate issued by the respondent bank in favour of the petitioner under SARFAESI Act, 2002.

The facts are that on 26.06.2018, the petitioner, being the highest bidder in public auction, purchased the property bearing No. G-2/3, Ground Floor, Block-G, Pocket-2, Sector-16, Rohini, New Delhi for an amount of Rs. 32.50 lakhs.

The petitioner vide letter dated 27.06.2018 was informed by the that one Ms. Santosh Kumari has challenged the auction proceedings before the Debt Recovery Tribunal ("DRT") and the present auction would be subject to the decision of the pending proceedings. Thereafter, Ms. Kumari has approached Debt Recovery Appellate Tribunal.

Mr. Rout, learned standing counsel for the respondent, states that the property was sold on as-is where-is basis and since the petitioner is the highest bidder as the auction purchaser, the respondent has already issued the sale certificate in favour of the petitioner. 5.
For the said reasons, it is directed that the respondent shall execute the sale deed in respect of the above property in favour of the petitioner on the petitioner paying the stamp duty expeditiously and in any case not later than 4 weeks from today.

In case the orders are not complied with, the petitioner shall be at liberty to revive the petition.
