This petition is filed on behalf of the Petitioner under Section 29A (4) of the Arbitration and Conciliation Act, 1996 seeking extension of the mandate of the Sole Arbitrator by a period of 9 months. 2.

Learned counsel for the Petitioner submits that the arbitral proceedings are at the stage of final arguments and the mandate of the learned Arbitrator has expired on 31.05.2025 and the mandate be extended so that proceedings can be concluded and award can be passed. 3.

Notice was issued to the Respondent on 25.07.2025, through all permissible modes. Fresh notice was issued on 18.08.2025 on the Petitioner furnishing fresh address of the Respondent, as the Respondent was unavailable on the given address. On 19.09.2025, Mr. Jha, Advocate appeared for the Respondent and sought copy of the petition and two weeks time to file reply, which was granted. On 24.09.2025 again copy of the petition was sought albeit counsel for Petitioner submitted that copy had O.M.P.(MISC.)(COMM.) 560/2025 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. been served. On 26.09.2025, none appeared for the Respondent despite two calls and matter was adjourned for today, making it clear that if the Respondent was unrepresented, he will be proceeded ex parte. 4.

None has appeared for the Respondent today despite two calls. The arbitral proceedings are at a standstill, owing to pendency of this petition and it appears that Respondent is not interested in contesting the present petition. Accordingly, this petition is allowed extending the mandate of the learned Arbitrator by a period of 9 months from today and period between 01.06.2025 to 07.10.2025 is regularized since the mandate of the Arbitrator expired on 31.05.2025.

Petition is disposed of in the aforesaid terms.
