% 14.01.2019 CM APPL. No. 1404/2019 (under Order XXIII Rule 3 r/w section 151 CPC on behalf of the parties) Mr. Ashok Kumar Aggarwal, Director of Shradha Poly Prints N Packs P Ltd., is present in person. He accepts that appellant has entered into compromise with the respondent and also accepts his signature on the application, affidavit and Memorandum of Settlement. He has produced before us the Election Card issued by the Election Commission of India, photocopy of which will be placed on record.

Authorised representative Ms. Sharvari Pandit is present in person and acknowledges and recognises signature of Ms. Swati Majumdar Regional Legal Manager-North of the respondent on the application, supporting affidavit and enclosed documents including Memorandum of Settlement. Demand Draft of Rs. 4 lacs will be handed over to the appellant today itself after disposal of a similar application in FAO 315/2014.

The compromise is accordingly taken on record and accepted. The appeal is disposed of in terms of the compromise, modifying the impugned order. No costs.
