The present writ petition has been filed praying for directions to the respondent no. 1-Municipal Corporation of Delhi ("MCD"), to take action against the unauthorized construction in property bearing no. D-2/31/32, Budh Vihar Phase-1, Near Khatu Shyam Mandir, Delhi-110086. 2.
Responding to the present writ petition, learned counsel appearing for the MCD draws the attention of this Court to the photographs attached along with the present petition, i.e., Annexure P-5. 3.
She submits that while the present writ petition has been filed qua property situated in Budh Vihar Phase-1, the photographs attached with the present writ petition are pertaining to some property in Vijay Vihar Phase-1, The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. which is approximately 1.5 kilometers away from the property mentioned in the writ petition, i.e., Budh Vihar Phase-1.

She further submits that the same petitioner has filed another writ petition being W.P.(C) 10237/2025, with respect to unauthorized construction in same property in Vijay Vihar. 5.
She, however, submits that despite the aforesaid, the MCD has already initiated requisite action against the property as mentioned in the present petition and Demolition Order dated 23rd July, 2025 has been issued. She further submits that requisite action in accordance with law shall be taken by the MCD, after following the due procedure. 6.
Considering the submissions made before this Court, it is manifest that the present petition has been filed by the petitioner in a mechanical manner, wherein, there is a mismatch between the property mentioned in the writ petition and the photographs filed in the writ petition. 7.
Considering the fact that the MCD has already initiated action against the property in question, no further orders are required to be passed in the present writ petition.

However, considering the conduct of the petitioner, the present writ petition is disposed of with a cost of Rs. 10,000/-, imposed upon the petitioner, payable to the Delhi High Court Advocates Welfare Trust, A/c No. 15530210002995, Bank Name: UCO Bank, Branch Address: Delhi High Court, IFSC: UCBA0001553.
