The learned counsel appearing for the appellant seeks to withdraw the present appeal as he states that the reliefs sought have become infructuous - the contract in question has been terminated and the bank guarantees have been encashed. He, however, seeks liberty to take appropriate steps for appointment of an arbitrator and for reference of the disputes to arbitration. 2.

The appeal is dismissed as withdrawn. All pending applications are also disposed of.
