Learned counsel for the petitioner states that during the pendency of the present petition, the respondents have issued a fresh notice to show cause dated 21st March, 2016 to the petitioner calling upon him to explain as to why his candidature should not be cancelled from the examination of SI in CPOs/Assistant Sub-Inspectors in CISF and Intelligent Officer in NCB Examination 2011and why he may not be debarred for five years from appearing in the said examination, due to indulging in unfair means. 2.
Learned counsel for the petitioner states that this is the third notice to show cause issued by the respondents on the same cause of action and in the present petition, the petitioner had assailed the order dated 24th/30th W.P.(C) 1704/2016
December, 2013 whereunder he has been debarred for a period of five years from appearing in the Commission's examination. 3.
In view of the fresh notice to show cause dated 21st March, 2016 issued to the petitioner, the present petition is disposed of by quashing the earlier impugned order dated 24th/30th December, 2013 that does not survive any longer. Liberty is granted to the petitioner to file a reply to the notice to the fresh show cause dated 21st March, 2016. 4.
