O R D E R

% 26.07.2024 CRL.M.A. 21748/2024 By way of the present application filed under section 440 read with section 482 of the Code of Criminal Procedure 1973, the petitioner seeks modification of the conditions imposed on grant of regular bail vide order dated 03.07.2024.

Mr. Gaurav Jain, learned counsel for the petitioner submits, that the petitioner has two family members, his wife and his 23 year old son. He submits that the petitioner's wife is a co-accused in the matter; and that therefore, the petitioner has not been able to arrange surety from two family members.

Furthermore, it is submitted that though the petitioner's son is willing to stand surety, he would not be able to furnish a surety bond of Rs.25,000/- based on an appropriate asset, and therefore, the quantum of the surety bond be also reduced.

The petitioner was granted bail vide order dated 03.07.2024. Evidently, he has still not been able to avail the order. Issue notice.

Mr. Manoj Pant, learned APP appears on behalf of the State on advance copy; accepts notice; and leaves it to the court to pass appropriate orders.

Upon an overall consideration of the facts and circumstances of the case, order dated 03.07.2024 admitting the petitioner to regular bail is modified, to the extent that the petitioner is directed to be released on bail upon furnishing a personal bond of Rs.15,000/- with one surety in the like amount from his son, to the satisfaction of the learned Trial Court. All other conditions imposed vide order dated 03.07.2024, shall remain as they are.

Application stands disposed-of.
