An application under Section 438 Cr.P.C has been filed on behalf of the petitioner for grant of Anticipatory Bail in case FIR No.173/2023 under Section 376/506/328 IPC registered at Police Station Mohan Garden. 2.

It is submitted that the accused has already joined the investigations and even handed over his mobile phone.

The investigations are complete and Chargesheet has already been filed against the petitioner without his arrest.

He has duly cooperated and is no longer required for further investigations.

In case he is required, he undertakes to join further investigations.

The learned Prosecutor on instructions from the I.O states that the main Chargesheet stands filed in the Court. The Mobile phone has been sent to FSL for which the Supplementary Chargesheet shall be filed. 4.

Learned counsel on behalf of the respondent No.2/complainant submits that there were threats extended at the instance of the petitioner/accused by the I.O and an FIR has also been registered against the I.O. If the accused is admitted to bail, there is an apprehension of further threats being extended to the Complainant.

Learned counsel on behalf of the petitioner in rejoinder has submitted that the FIR is only against the I.O and he was in no manner involved in extending threats.

Considering that the Chargesheet already stands filed in the Court, the petition is disposed of with liberty to the petitioner to approach the trial Court for regular bail.

The Interim protection against arrest to continue for 15 days till the filing of the bail application.

The Bail Application is disposed of.
