The present petition has been filed on behalf of the petitioner seeking cancellation of regular bail granted to respondent no. 2 vide order dated 09.07.2024.

It is argued by the learned counsel that the conduct of respondent no.2/accused Ayush Shiwan is such that he is not qualified to get liberty of bail, as after getting the bail, he is continuously interacting with the complainant and his family in an offensive manner, by posting his videos on social media handle. It is submitted that respondent no. 2, after being released on bail, is not only abusing the process of law, but encouraging the crimes in State, and passing the wrong message to public at large. It is further submitted that respondent no. 2 had committed the heinous offence against the society and not just an individual. It is, thus, prayed that the bail granted to respondent no. 2 vide order dated 09.07.2024 be cancelled. This Court is informed that one of the family members of the complainant has unfortunately met with an accident. However, this Court takes note of the fact that respondent no. 2 was in judicial custody when the incident in question had taken place and therefore, that could not have been a ground for cancellation of regular bail granted to respondent no. 2. 4.

This Court also takes note of the fact that bail in this case was granted in the year 2024 itself. This Court directs that in case of any threats being extended by the accused or intimidation, the petitioner will be at liberty to approach the learned Chairman of the Witness Protection Committee (WPC) concerned in this case. The concerned Investigating Officer will ensure that in case any complaint is filed by the complainant, the same will be decided as per law.

Considering the overall facts and circumstances of the case, this Court is not inclined to cancel the bail granted to respondent no. 2. 6.

In view of above, the present petition stands disposed of. 7.
