Submission of the learned senior counsel for the petitioner is that he would be making an appropriate representation to the Department as his earlier representation has been answered only on the ground of limitation by the order of the Department dated 12.01.2017; the merits of his representation has not been considered. This is disputed by the respondent who submits that this representation does not contain the arguments are now sought to be propounded by the petitioner.

The petitioner is permitted to file a presentation within one
