The petitioners have filed this petition, under Section 29A of the Arbitration and Conciliation Act, 1996 ["the Act"], seeking an extension of the mandate of the learned Arbitral Tribunal, which is in seisin of disputes between the parties under concession agreements dated 11.01.2011 and 20.06.2013.

The arbitral proceedings commenced pursuant to orders dated 11.05.2017 and 05.07.2017 passed by this Court in ARB. P. 236238/2017 and 239/2017. The mandate of the Tribunal has been extended from time to time, lastly by judgment dated 03.08.2023 in O.M.P.(MISC.)(COMM) 222/2023.

The mandate has expired on 02.08.2024.

Mr. Karn Bhardwaj, learned Additional Standing Counsel, appears on behalf of the respondent and states that the respondent has no objection to the relief sought.

I am informed that the arbitral proceedings have been pending since 2017 as seven arbitrations, arising out of similar contracts [albeit between different parties], are being taken up together. 5.

However, as the proceedings have been pending for a considerable period, learned counsel for both parties assure the Court that they will cooperate with the learned Arbitral Tribunal so that the proceedings can be disposed of within the next year.

With the consent of learned counsel for the parties, the petition is allowed, and the mandate of the learned Arbitral Tribunal is extended by a period of one year, with effect from 03.08.2024.
