Learned counsel for the plaintiff states that the plaintiff has executed a settlement agreement with defendant nos. 1 and 2 on 18.09.2024 before Samadhan-Delhi High Court Mediation and Conciliation Centre. He states that in view of the terms agreed in the said settlement agreement, the plaintiff's cause of action against defendant nos. 1 and 2 stands satisfied. He, therefore, seeks liberty to withdraw the present suit. He also states that no relief was sought against defendant nos. 3 and 4 in the suit and they were merely impleaded as proforma parties.

Learned counsel for defendant nos. 1 and 2 as well states that defendant nos. 1 and 2 shall abide by the terms and conditions agreed in the settlement agreement dated 18.09.2024.

Learned counsel for the plaintiff states that in view of the settlement, the Court fees be refunded in terms of Section 16 of the Court Fees Act, 1870.

Accordingly, the suit is dismissed as withdrawn. 5.

Defendant nos. 3 and 4 are deleted from the array of parties. 6.

In addition, in view of the fact that the suit has been settled before Delhi High Court Mediation and Conciliation Centre, and in accordance with Section 16 of the Court Fees Act, 1870, the registry is directed to refund 100% Court fees within four (4) weeks to the plaintiff in accordance with Rules.
