Sixth Bail Application under Section 483 read with Section 528 of the Bhartiya Nagrik Suraksha Sanhita, 2023 ("BNSS") has been filed on behalf of the Applicant/Petitioner Ankit Bisht @ Nikki for extension of interim bail granted by the learned Trial Court vide order dated 15.07.2025, considering the medical condition of his wife.

It is submitted in the Application that the Applicant was granted interim bail from 20.07.2025 to 24.07.2025 by the learned ASJ vide Order dated 15.07.2025 as the surgery of Applicant's wife was scheduled for 21.07.2025. The Application was filed before the learned ASJ for further extension but the same has been denied vide Order dated 24.07.2025. Hence, the present Application has been filed seeking extension of interim bail. 6.

Learned counsel for the Petitioner submits that the date for surgery of his wife shall be given by the Doctor today and the interim bail be accordingly extended for a period of 06 weeks. 7.

Learned APP for the State appears on advance Notice and takes serious objections. He submits that even though the interim bail was taken on the pretext of the scheduled surgery of his wife on 21.07.2025, but the wife did not visit the hospital till 23.07.2025. 8.

It is submitted that this is nothing but a ploy to get the interim bail. Furthermore, there is no medical record to suggest the date of surgery. Therefore, it is submitted that there is no ground for extension of interim bail.

There is not a single medical document on record to either support that she has got admitted in the hospital or visited the hospital on 20.07.2025 or 21.07.2025 or that the surgery could not be done on account of her poor health. Now also, there is no date of surgery which has been finalized. 11.

In these circumstances, there is no justification for extension of interim bail, which is hereby dismissed. However, the petitioner is at liberty to seek interim bail in case of finalization of date of surgery. 12.

Learned counsel for the petitioner submits that he shall surrender before the Jail Superintendent tomorrow by 07:00 pm. 13.
