First Bail Application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of the Applicant-Imran for grant of Regular Bail in FIR No. 0112/2025 registered under Sections 309(4)/311/3(5) BNS, 2023 at P.S. Madhu Vihar. 2.
It is submitted in the Application that on 07.04.2025, the Complainant called the Applicant to his Fruit Shop near Trilokya Apartment, Delhi. Thereafter, Applicant and other co-accused persons, namely, Afzal and Sohil came on a scooty to meet the Complainant. In the meanwhile, other co-accused Arshad also reached at the spot. They all started talking but during the conversation, some heated argument took place between the Complainant and Afzal, Sohil and Arshad, which resulted into a quarrel and manhandelling amongst them. was neither involved in the quarrel nor did he assault the Complainant in any manner.

The FIR got registered on 08.04.2025. The investigations are complete and the Chargesheet already stands filed. The custodial interrogation of the Applicant is not required.

It is further stated that the Applicant has clean antecedents and has has no prior involvement. There is no prima facie case made out against him. He has been implicated falsely in this case. There are no chances of his absconding or tampering with the witnesses. The detention of the Applicant would amount to the pre-conviction without trial. 5.
Reliance is placed on Jagdish Nautiyal v. State, 2003 (1) JCC 311; Suresh Kalmadi v. CBI (Delhi), 2012(1) JCC 734; Prabhakar Tewari v. State of U.P. & Anr, (2020) 11 SCC 648; Vaman Narain Ghiya v. State of Rajasthan, (2009) 2 SCC 281; Satendar Kumar Antil v. CBI, SLP (CRL.) No. 5191 of 2021.

A prayer is, therefore, made that the Applicant be admitted to Bail. 7.
The Status Report has been filed against the Applicant and the same is taken on record wherein it is explained that in a fight took place between the Complainant and others and the Accused persons, in which 02 persons got injured. MLC of injured Complainant/Anil was obtained, according to which, he lacerated wound on the left side abdomen. The other injured Durgesh also suffered a lacerated injury.

The Applicant was arrested on 12.02.2025. The investigations have been completed and the Chargesheet has been filed. 9.
Learned Prosecutor submits that the appropriate orders in the circumstance of the case, may be passed.

As per the allegations, in a sudden fight, which took place on 07.04.2025. Rs.7000/- were snatched from the Complainant and the other co-accused, namely, Sohil and Afzal, inflicted light injuries on the two other injured persons. The Chargesheet stands filed. There is no allegation of the injury having been inflicted by the Applicant. 11.
Considering the totality of circumstances, the Applicant is admitted to Bail, subject to the following terms and conditions:- a) The Applicant/Accused shall furnish a personal bond of Rs.35,000/- and one Surety of the like amount, subject to the satisfaction of the learned Trial Court.
b) The Applicant/Accused shall appear before the Court as and when the matter is taken up for hearing;
c) The Applicant/Accused shall provide his mobile number/changed mobile number to the IO concerned which shall be kept in working condition at all times;
d) The Applicant/Accused shall not indulge in any criminal activity and shall not communicate or intimidate the witnesses. e) In case the Applicant/Accused changes his residential address, the same shall be intimated to learned Trial Court and to the concerned I.O.

The copy of this Order be communicated to the concerned Jail Superintendent, as well as, to the learned Trial Court for information and compliance.
