Writ Petition under Article 226 of the Constitution of India read with Section 529 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ('BNSS') has been preferred on behalf of the petitioner with the following prayer : "Pass a writ/writs, order/orders, direction /directions thereby directing the respondent Nos.l to 4 to provide appropriate police protection to the Petitioner and Pass a writ/writs, order/orders, direction /directions thereby directing the respondent No.l to 4 to take appropriate and stringent action against the accused persons on the complaints/FIR No.0300/2024 lodged by the Petitioner, in the interest of justice."

Learned counsel for petitioner submits that petitioner apprehends threat to his life and also requests for necessary action to be taken on behalf of respondent No. 1 to 4, since there is a dispute regarding a parcel of land in Village Matiala, which was purchased by father of petitioner, but the said transaction is opposed by Satish and his son Aakash. Efforts are also stated to have been made to take forceful possession of the land. Further, an FIR No. 0300/2024, under Section 125 Bharatiya Nyaya Sanhita and Sections 25/27 Arms Act was lodged at PS: Binda Pur, with respect to a firing incident on 19.07.2024.

Learned ASC for the State submits that FIR in respect of the alleged incident of firing was registered and the accused were arrested. He further submits that assessment of the threat perception shall be made within three weeks by the competent authority and necessary action shall be taken in accordance with law. He further informs that in the meantime, the phone numbers of SHO as well as Beat Officer concerned shall be shared with the petitioner.

Taking the statement of learned ASC for the State on record, petition is accordingly disposed of with directions to respondent No. 1 to 4 to assess threat perception within three weeks, and take requisite measures in accordance with law.

Petitioner is also at liberty to file an appropriate application before the District Witness Protection Committee, Dwarka for consideration, in case any additional security measures are required to be undertaken in the aforesaid FIR No. 0300/2024 registered at PS: Binda Pur.
