This petition is preferred on behalf of the Petitioner under Section 29A (4) and (5) of the Arbitration and Conciliation Act, 1996 ('1996 Act') seeking extension of the mandate of the Arbitral Tribunal. 2.

Arbitral proceedings commenced between the parties on 07.07.2019 and were kept in abeyance due to Pandemic COVID-19. Proceedings were resumed on 29.10.2022, when issues were settled and thereafter recording of evidence started. At that stage, the Presiding Arbitrator expired on 27.09.2023 and vide order dated 02.02.2024 in OMP (T) (COMM) 7/2024, this Court appointed the substitute Presiding Arbitrator. Arbitral proceedings are stated to be at the stage of evidence of Respondent No. 3 and the mandate of the Arbitral Tribunal has expired on 02.02.2025. 3.

on instructions, submit that the said Respondents have no objection to the extension of the mandate of the Arbitral Tribunal. Insofar as Respondents No. 4 and 5 are concerned, learned counsel for the Petitioner submits that these are proforma Respondents and are being represented by Petitioner's counsel before the Arbitral Tribunal.

Accordingly, with the consent of the parties and considering that the arbitral proceedings are at the stage of Respondent No. 3's evidence, mandate of the Arbitral Tribunal is extended by a period of 12 months from 28.07.2025 and period between 03.02.2025 to 27.07.2025 is regularized. 6.

Petition is allowed and disposed of in the aforesaid terms.
