This is a petition filed under Section 29A (5) of the Arbitration and Conciliation Act, 1996 seeking extension of the mandate of the Arbitral Tribunal by a further period of six months to make and publish the final Award.

It is stated that after the pleadings were completed, the petitioner moved an application for filing additional documents on record, which were relevant to the issue in controversy. The disposal of the application took some time and the same is still pending. It is further stated that the proceedings are still at the stage of examination of witnesses. Hence, the delay.

Mr. Deo, learned counsel for the respondent states that he has filed a reply. However, the same is not on record. The respondent shall place the reply on record.

A copy of the same has been perused from the Ipad of the learned counsel for the petitioner.

application for filing additional documents on record by the petitioner is misconceived and that the said documents were within the knowledge and possession of the petitioner and the same should have been filed before.

I am of the view that the parties have invested considerable time, effort and resources in the arbitral proceedings. The filing of an application for additional documents cannot be considered to be "intentionally and malafidely delaying the arbitration process" tactic. 7.

Hence, sufficient cause has been shown for the delay. For the said reasons, the petition is allowed and the mandate of the Arbitral Tribunal is extended by a period of six months from today. 8.

The period from 28.03.2025 till today stands regularised. 9.

The petition is disposed of accordingly.
