By way of the present petition, the petitioner is seeking following prayer:

"A. Call the Trial Court Record.

B. Issue an appropriate Writ/order thereby directing the Trial Court (i.e in court of sh. Anubhay bijalwan, Ld. Judicial magistrate first class (NI act) digital courts, South West Dwarka Court, in case titled Vaish Chandrashan Cooperative Society Itd vs Arun Kumar Mehta, case no. CC NI act 32604/2022, in a fixed time frame on day to day basis, or conclude a trial within 3months, in the interest of Justice." 4.

This Court notes that the summoning order in this case was passed on 07.12.2022. The accused had put in appearance before the learned Trial Court on 07.02.2023. The record reveals that the accused before the learned Trial Court is seeking repeated adjournments and NBWs have been issued against him. Costs have also been imposed on him on at least five dates of hearing, which have not been paid, and the matter is pending for recording of the evidence of complainant for last about two years. 6.

In these circumstances, the learned Magistrate is requested to ensure that the trial is conducted expeditiously and the case is decided within a period of 04 months, in accordance with law.

Accordingly, the present petition is disposed of in above terms. 8.

Copy of this order be forwarded to the learned Magistrate for necessary information and compliance.
