The petitioners vide the present petition under Article 226 of the Constitution of India Section 482 of the Code of Criminal Procedure, 1973 seek quashing of FIR No. 293/2016 registered under Sections 63 and 65 of the Copyright Act, 1957 and 103 & 104 of Trademarks Act, 1999 at P.S. G.T.B Enclave, Delhi and all proceeding emanating therefrom in view of the Settlement arrived at between the parties.

Issue notice. Learned ASC accepts notice on behalf of the State. 3.
A request for quashing of the FIR has been made on account of the Settlement inter se the parties. It was settled between the parties through Settlement Deed dated 03.02.2020 that the petitioners shall pay a sum of Rs. 1,00,000/- to the respondent no. 2 as full and final amount. the petitioners have paid Rs.1,00,000/- in cash in the Court to the Authorised Representative of Kent Fans and Electrical Pvt. Ltd. The parties are present before this Court in person today, and have been identified by their counsel and Investigating Officer concerned.

Mr. Raj Kumar Sharma has appeared and it is submitted the previous authorised representative has left the company and now Mr. Raj Kumar Sharma has been authorised by the Board on 04.07.2024. Today, the Authorised Representative of Kent endorses the Settlement and states that he has received all amounts due to him and has no objection if the FIR is quashed.

In view of the above facts that the parties have amicably resolved their differences out of their own free will and without any coercion. Hence, it would be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. Moreover, there is no legal impediment in quashing the FIR in question.

Accordingly, FIR No. 293/2016 registered under Sections 63 and 65 of the Copyright Act, 1957 and 103 & 104 of Trademarks Act, 1999 at P.S. G.T.B Enclave, Delhi and all consequential proceedings emanating therefrom are quashed.

The petition stands disposed of.
