The present petition under Section 2(B) and Section 12 of the Contempt of Courts Act, 1971 read with Article 226 of the Constitution of India seeks the following prayers:

"I. Initiate contempt proceedings against the contemnor(s) for not complying with the order dated 29.03.2023 in the case titled Ranveer Singh Chuhan versus Govt. of NCT of Delhi & Ors. in W.P (C)10785 of 2018 In which the court directed to the respondent Contemnor to consider the eligibility of the petitioner in accordance with law.

II.

Pass an order directing the respondent/ contemnors to ensure compliance of the order dated 29.03.2023 in W.P (C) 10785 of 2018 in the matter titled Ranveer Singh Chuhan versus Govt. of NCT of Delhi & Ors.

III. Pass such other and further Order(s) as this Hon'ble Court may deem fit and proper on the facts and circumstances of the case."

The grievance of the petitioner is that the respondents has violated the directions given in judgment dated 29.03.2023, in W.P.(C) 10785/2018, whereby the following directions were passed: "9. Ms. Ahlawat draws the attention of the Court to para 5 of the reply and points out that the zone of consideration has to be fixed as per DoPT O.M. dated 05.01.2006 and also states that Petitioner is incorrect in stating that post of Assistant Nursing Superintendent is a Group 'C' post. She submits that the post is a Group 'B' post and no separate methodology can be followed for promoting the Petitioner as the Department is bound to follow the DoPT O.M. dated 01.08.2011 which is annexed to the reply and the laid down procedure has been scrupulously followed.

Insofar as the eligibility of the Petitioner is concerned, this Court finds that Respondents have stated in paras 6 and 7 of the reply that Petitioner was promoted to the post of Senior Nursing Officer on 03.01.2020 and since he had not completed 03 years service on the said post, he was at that stage not eligible for promotion to the post of Assistant Nursing Superintendent.

10. In view of the stand of the Respondents, in my view, the grievances ventilated by the Petitioner stand redressed and no further orders are required to be passed. Needless to state as and when the Petitioner attains eligibility, he shall be considered in accordance with law."

The petitioner's case is that despite attaining the eligibility, he has not been considered for promotion.

Learned counsel for the respondent has placed on record copy of order dated 07.08.2024, wherein it is recorded that the petitioner has been promoted from Senior Nursing Officer to Assistant Nursing Superintendent. 6.

Learned counsel for the petitioner submits that the promotion ought to have been given as a Senior Nursing Superintendent. 7.

attaining eligibility, he shall be considered for promotion in accordance with law. If the petitioner has any grievance with the promotion so granted, he is always at liberty to initiate appropriate proceedings in accordance with law. 8.

So far as this petition is concerned, nothing survives in the present petition, accordingly, the same is disposed of. 9.
