The present appeals arise out of the order dated 01.08.2019 passed by the learned ADJ, Dwarka Courts, New Delhi in CS No.17505/2016 and 17746/2016, whereby the appellants, who were defendants in the said suits, had filed an application under Order IX Rule 13 CPC for setting aside the ex-parte judgment and decree dated 31.08.2018, which came to be dismissed.

After some arguments, learned counsel appearing for the respondent fairly submits that he has no objection in case the appeals are allowed and the suits are restored to their original number. He however, submits that costs be imposed on the appellants for non-appearance. In view of the aforesaid, the impugned order is set aside and the suits are restored to their original numbers, subject to costs of Rs.25,000/- to be paid in each of the appeals.
