% 20.02.2017 Crl. M.A. No. 3051/2017 Exemption allowed, subject to all just exceptions. The application stands disposed of.

BAIL APPLN. 310/2017 After some arguments, learned counsel for the petitioner wishes to withdraw the bail application. However, the grievance of the petitioner is that the prosecutrix is not appearing for recording of her evidence despite three adjournments. It is informed that the next date in the case is 10.03.2017. The prosecution is directed to produce the prosecutrix and all other independent witnesses without any delay. The Trial Court shall not

grant any undue adjournments either to the prosecution or the accused. Once the evidence of the prosecutrix and the other independent witnesses is recorded, it shall be open to the petitioner to apply for bail afresh. If such an application is made, the same shall be considered on its own merits by the Trial Court.
