Despite the fact the Appellant has reportedly expired in the year 2011, this fact could not be verified till date.

Learned counsel appearing on behalf of the Appellant says that she has made all efforts under her command and beyond that she is not in a position to do anything else. She has placed on record various e-mails exchanged to substantiate her version.

Learned counsel appearing on behalf of the Respondent says that in such circumstances there is no point to continue with this appeal, and endorse the request of Appellant, that appeal be disposed of / dismissed for non-prosecution.

In view of the circumstances, the appeal stands dismissed for nonprosecution.
