The respondent, Mr. Sanjeev Kataria is present in person. Let the memo of parties be amended to reflect the correct name / spelling of the respondent.

Learned counsel for the respondent undertakes, on instructions, that immediate steps shall be taken to comply with the terms of the Mediation Settlement Agreement dated 04.07.2024. It is assured and undertaken by the respondent, on instructions that the requisite steps shall be taken to immediately file the first motion petition, followed by the second motion petition, as per the prescribed Rules.

The said undertaking is taken on record.

It is agreed that any breach of the aforesaid undertaking shall be construed as egregious and wilful disobedience by the respondent of the orders passed by this Court, entailing severe action under the Contempt of Courts Act, 1971.
