The present application under Order XXIII Rule 1 read with Section 151 of the CPC filed on behalf of the petitioner/applicant seeks the following prayers: - "a. Allow the present Application u/o XXIII Rule 1 read with section 151 CPC, 1908, CPC 1908 and permit the Petitioner to withdraw the captioned Contempt Petition, with the liberty to proceed in accordance with law in future, if required; and b. Pass such other or further orders as this Hon'ble Court may deem fit and proper in the interest of justice." 3.
During the pendency of the captioned petition, the parties have agreed that without prejudice to their rights, they would withdraw all the respective legal proceedings pending before Tis Hazari Courts as well as before this Court with liberty to approach the Court, if needed in future. 4.
