After canvassing some arguments, learned counsel appearing on behalf of the Petitioner, on instructions, states that he will not press on the maintainability of this petition in this Court if the petition is transferred to the Central Administrative Tribunal considering that notice was issued by this Court pursuant to which the Medical Board was constituted and sealed cover has been sent by the Board of Research and Referral Hospital, Delhi Cantt., New Delhi.

Considering this submission of the counsel for the Petitioner, this petition is transferred to the Central Administrative Tribunal. Petition shall be listed before the learned Chairman on 12.08.2024. 3.
Registry is directed to transfer the entire records of the writ petition along with sealed cover received from Research and Referral Hospital. Counsels for the parties confirm that the envelope is sealed. Learned Registrar General will ensure that the sealed cover is sent to Registrar of the Central Administrative Tribunal and is kept in his custody till the matter is heard by the Court.
