The instant petition under Section 528 of the Bhartiya Nagarik Suraksha Sanhita, 2023 (hereinafter "BNSS") earlier Section 482 of the Code of Criminal Procedure, 1973 (hereinafter "CrPC"), has been filed by the petitioner praying for quashing of FIR 357/2022 registered at Police Station Wazirabad, Delhi on 24.04.2022, for offences punishable under Sections 279/337 of the Indian Penal Code, 1860 (hereinafter "IPC"). 2.
The petitioner is present before this Court and has been identified by his counsel and the Investigating Officer, Police Station Wazirabad. respondent no. 2 is also present in the Court and has been identified by his counsel and the Investigating Officer.

The brief facts of the case, having been admitted, are that on 24.04.2022, respondent no. 2 was hit by a TSR being driven at high speed and on the wrong side near Jagatpur Flyover while he was on his motorcycle, resulting in injuries, land the registration of the FIR in question. Learned counsel appearing on behalf of the petitioner submitted that the petitioner and respondent no. 2 have settled their disputes amicably through oral settlement/compromise deed.

On a query made by this Court, respondent no. 2 has categorically stated that he has entered into this compromise on his own free will and without any pressure. It is also stated by him that the entire dispute has been amicably settled between the parties 6.
Affidavit of respondent no. 2 is on record and has been annexed as Annexure-P5. On the basis of this affidavit, respondent no. 2 has agreed to withdraw the case arising out of FIR 357/2022 registered at Police Station Wazirabad.

It is prayed by the learned counsel appearing on behalf of the parties that the instant FIR may be quashed on the basis of the compromise. 8.
Heard learned counsel for the parties and perused the record. 9.
Keeping in view the fact that the matter stands amicably been settled between the petitioners and the respondent no. 2 amicably without any pressure, no fruitful purpose would be served by keeping the matter pending. 10.
Hence, in light of the judgment of the Hon'ble Supreme Court passed in Gian Singh vs. State of Punjab (2012) 10 SCC 303, FIR 357/2022 registered at Police Station Wazirabad on 24.04.2022, for offences punishable under Sections 279/337 of the IPC, and consequent proceedings emanating therefrom, are quashed.
The petition, along with pending applications, if any, stands disposed of.
