notices dated 27.12.2024 and 20.01.2025 no. DPCCas the same were issued without following any provisions of law. 2.
The sole grievance of the petitioner is that impugned order dated 14.05.2026 has been passed without affording an opportunity of hearing. 3.
Bare perusal of the impugned order dated 14.05.2026 indicates that the same has been passed without assigining the reason as to why the response to the Show Cause Notices (SCN) dated 27.12.2024 and 20.01.2025 was not satisfactory.
4.
Under almost similar circumstances, this Court in the case of M/s India Navigation Company vs. Govt. Of NCT of Delhi & Anr.1, has set aside the notice while directing the Delhi Pollution Control Committee (DPCC) to issue a fresh notice to the petitioner and after affording an opportunity of hearing, to pass a speaking order. 5.
Accordingly, the instant petition also stands disposed of with the similar directions.
6.
The impugned order dated 14.05.2026 stands set aside. The respondent-DPCC shall be at liberty to issue a fresh SCN and to pass appropriate reasoned order after affording opportunity of hearing to the petitioner, in accordance with law.
7.
All rights and contentions of the parties are left open.
