IN THE HIGH COURT OF DELHI AT NEW DELHI

+ W.P.(CRL) 3566/2019 SURAJ CHAUHAN @ BITTTOO ..... Petitioner Through Mr Mayank Mikwail Mukherjee, Advocate from DHCLSC.

versus STATE ..... Respondent Through Mr Rajesh Mahajan, ASC for State with Ms Jyoti Babbar, Ms Smita Vedi, Advocates.

CORAM:

HON'BLE MR. JUSTICE VIBHU BAKHRU

O R D E R

% 28.01.2020 1.

The petitioner has filed the present petition impugning an order dated 17.07.2019 passed by the respondent, rejecting the petitioner's application for parole in terms of Rule 1210 (II) of the Delhi Prison Rules, 2018. 2.

The petitioner was imposed punishment on multiple occasions. Rule 1210 (II) of the aforesaid Rules requires the conduct of the convict to be uniformly good for at least two years, in case he is awarded major a punishment(s). In view of the above, this Court had directed the jail authorities to submit a report which has been handed over to the Court today.

3.

The report indicates that the earlier punishments awarded to the petitioner were minor, however, the petitioner has also been awarded a punishment on 09.12.2019 which appears to be a major punishment.

4.

In view of the above, this Court finds no infirmity with the impugned order.

5.

The petition is, accordingly, rejected.
