% 19.09.2025 I.A. 23545/2025 (u/O-XXIII Rule 3 of the CPC) 1.

This is a joint application filed under Order XXIII Rule 3 of the Code of Civil Procedure, 1908 for recording of compromise arrived at between the parties.

The application bears the signatures of the authorized representatives of the parties and their respective counsel and is duly supported by affidavits of the parties.

Along with the present application, the Settlement Agreement dated 13th September, 2025 (hereinafter 'Settlement Agreement') has been placed on record which bears the signatures of the parties. 4.

In terms of the Settlement Agreement, the parties have agreed that the petitioner shall pay a sum of Rs. 87,50,000/- towards full and final O.M.P. settlement of all claims arising under the Agreement dated 11th May, 2009, the Supplementary Agreement dated 10th July, 2009, and the Arbitral Award dated 18th July, 2019.

The demand draft for the aforesaid amount has been handed over to the counsel for the respondent.

I have perused the terms of the Settlement Agreement and find the same to be lawful.

7.

The parties shall remain bound by the terms and conditions of the Settlement Agreement.

The application stands disposed of.

In view of the order passed above in I.A. 23545/2025, the present petition is disposed of in terms of the Settlement Agreement. 10.

The Registry shall release the sum of Rs. 75,00,000/- deposited by the petitioner before this Court, along with accrued interest, in favour of the petitioner.
