W.P.(C) 13729/2019, CM APPL. 11282/2020 (for renewal of licence) & 55339/2020 (Stay) 1.

The application, CM Appl. No. 11282/2020, has been filed by the petitioner no. 1 praying for a direction to the respondent no. 2 to consider the renewal of L-12/L-12F licences of all licensees for the year 2020-21 on the same terms and conditions as they were for the year 2019-20 till 30.03.2021 or till the new terms and conditions for L-12/L-12F licences are framed.

The writ petition itself challenges the order dated 19.12.2019 passed by the Deputy Commissioner (Excise)/Licensing Authority withdrawing the L-12/L-12F licences of the petitioners herein.

Since the licenses of the petitioners were valid upto 31.03.2020, this Court, by an interim order dated 24.12.2019, had stayed the operation of the Impugned Order dated 19.12.2019. Unfortunately, due to the Covid-19 pandemic and the consequent lockdown declared by the Central Government, this petition could not be been taken up for final hearing. 4.

As the period of the licences has since expired on 31.03.2020, the petition itself has been rendered infructours. The same is allowed to be withdrawn by the petitioners with liberty to file appropriate writ petition seeking such relief as they may be entitled to in accordance with law. 5.

It is made clear that the order dated 24.12.2019 was merely a prima facie opinion of this Court and shall not prejudice either party in any proceedings as and when filed.

The present petition and all the pending applications are disposed of in the above terms.
