The instant petition under Section 482 of the Code of Criminal Procedure, 1973 (currently Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023) has been filed by the petitioner praying for quashing of the FIR bearing No. 666/2021 registered at Police Station Mangol Puri, for offences punishable under Sections 279/337 of the Indian Penal Code, 1860 (hereinafter "IPC").

The instant matter could not be settled between the parties as the respondent no. 2 was not present before this Court on the last date of hearing i.e., 13th August, 2024.

Mr. Subhash Chand, the petitioner present in-person before this Court and has been identified by his counsel Mr. Harsh Vashisht and Investigating Officer Mangol Puri, Police Station and Mr. Sachin, the respondent no. 2 also present in-person and has been identified by the Investigating Officer. 4.

stated that he has entered into compromise on her own free will and without any pressure. It is also stated by respondent No.2 that the entire dispute has been amicably settled between the parties.

It is prayed by the learned counsel for the parties that in terms of the settlement deed dated 15th July, 2024 at Rohini Courts, Delhi, the FIR bearing No. 666/2021 registered at Police Station Mangol Puri, may be quashed.

Mr. Satish Kumar, learned APP for the State submitted that there is no opposition to the prayer made by the petitioners seeking quashing of the FIR in question in view of the settlement arrived at between the parties. 7.
Heard learned counsel for the parties and perused the record. 8.
In the instant case, it is observed that the offence levelled against the petitioners under Section 279 of the IPC is non-compoundable in nature. However, keeping in view the fact that the matter has been amicably settled between the petitioners and respondent no. 1 without any pressure and recording no objection from the State, this Court is of the view that no fruitful purpose would be served by keeping the matter pending. 9.
Hence, in terms of the settlement agreement FIR bearing No. 666/2021 registered at Police Station Mangol Puri, for offences punishable under Sections 279/337 and consequent proceedings emanating therefrom are quashed.

The petition stands disposed of.
