This writ petition was preferred on behalf of the Petitioner for a direction to Respondent No.2 to constitute a Departmental Promotion Committee and to consider the Petitioner for promotion to the post of Senior Stenographer in Delhi Judicial Academy w.e.f May, 2017 with all consequential benefits.

It is a common case between the parties that during the pendency of the writ petition, Petitioner has been considered for promotion and granted promotion to the post of Senior Stenographer and the narrow issue that now remains is with respect to the date from which the promotion will take effect.

Ms. Anu Bagai, learned counsel for the Respondent No.1/Delhi High Court submits that Petitioner had made a representation for ante-dating his promotion but the same has been rejected by the Administrative Committee of this Court and therefore, this writ petition is rendered infructuous. 4.

In my view, there is merit in the submission of Ms. Bagai. This writ petition was filed for a limited direction to constitute a DPC and consider the case of the Petitioner as Senior Stenographer. During the pendency, Petitioner has been promoted and his representation for ante-dating the promotion has been rejected and therefore, this writ petition is infructuous. 5.

The writ petition is accordingly, disposed of giving liberty to the Petitioner to challenge the order passed on his representation as well raise all other issues flagged in the present writ petition with respect to grant of promotion from the date of vacancy since it is alleged by the Petitioner that for no fault of his, the skill test was delayed which impacted his promotion on time.

Pending application also stands disposed of.

It is made clear that this Court has not expressed any opinion on the merits of the case.
