The appellant plaintiff has assailed the dismissal of his suit for recovery of Rs. 28,00,000/-. The suit was dismissed mainly on the ground that the appellant concealed in his plaint that a sum of Rs. 17,00,000/- out of the said amount of Rs. 28,00,000/- had already been received by him from the respondent.

After addressing partly, learned counsel for appellant seeks permission to withdraw this appeal without prejudice to his stand in the FAO 57/2023, which arose out of grant of review and consequent setting aside of decree of Rs. 11,00,000/- under Order XII Rule 6 CPC. 3.

Accordingly, the appeal and applications are dismissed as withdrawn.
