The present Appeal, filed under Section 13(1A) of the Commercial Court Act, 2015, challenges the Judgment dated 02.05.2024 ["Impugned Judgment"], passed by the learned District Judge (Commercial) - 01, Central, Tis Hazari Courts, Delhi, in Suit (Comm.) 2885/2021 titled as "ICICI Bank Ltd. v. Rajeev Kumar &Anr.". By way of the Impugned Judgment, the learned District Judge passed judgment in favour of the Respondent No. l for recovery of Rs. 6,39,878/- (Rupees Six Lakhs Thirty-Nine Thousand Eight Hundred Seventy-Eight only).

withdraw the present Appeal, as the claim of the ICICI Bank Ltd. ["Respondent No. 1"] stands satisfied, which is not disputed by learned counsel for the Respondent No. 1.

Learned counsel for the Appellant further prays for the release of the amount deposited with the Registry of this Court, in compliance with the Order dated 13.08.2024, during the pendency of the present Appeal. The same is not opposed by the learned counsel for the Respondent No. 1.

Hence, in view of submissions made by learned counsel for the Appellant, the present Appeal is dismissed as withdrawn while directing the Worthy Registrar General of this Court to release the amount of Rs. 6,00,000/- to the Appellant, subject to due verification. 5.
