The present petition has been filed by the Petitioner under Article 226 of the Constitution of India read with Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 seeking a writ in the nature of habeas corpus for production of his daughter, Ms. 'J', who is stated to be missing since 9th May, 2024.

Vide order dated 13th August, 2024 it was directed that investigation be carried out and Ms. 'J' as also one Mr. Praveen Kumar be produced before the Court on the next date of hearing.

been traced. A status report dated 04th September, 2024 authored by SHO, PS Kapashera, Delhi has also been handed over by the State. The said application and the status report are taken on record. 5.

The girl has been produced before the Court today. The parents of the girl are also present. The Court has interacted with the girl as also her parents in the chamber.

The girl has attained majority on 6th August, 2024.

The girl has informed the Court that she is now staying in a Paying Guest accommodation, at Mitraon village and is giving tuitions to some children. She further states that she does not wish to go back to the parents. It is her stand that her parents were forcing her for marriage and were not supporting her wishes to continue with her studies. This is denied by the parents. 7.

She has given her mobile number to her parents. She has assured the Court that she would not change her mobile number in future, and in case of any change she will communicate the same to her parents. 8.

The girl also has a younger brother, and she has expressed her willingness to meet him whenever it is convenient. Accordingly, she can continue to meet her younger brother, as per her wishes, to which the parents have no objection.

The petition is, accordingly, disposed of.

All pending applications are also disposed of. Next date of hearing stands cancelled.
