This hearing has been done through hybrid mode. 2.

The present petition under Section 25-B (8) of Delhi Rent Control Act, seeks the following prayers:- "a) call for the records from the court of Shri Ajay Nagar, Addl. Rent Controller, West, Tis Hazari, Delhi of the case titled as "Mahesh Kumar Vs. Jeet Kumar" being the file of Eviction Petition bearing No. 65/2017;

b) set aside the impugned order dated 04.09.2019 passed by Shri Ajay Nagar, Addl. Rent Controller, West, Tis Hazari, Delhi in case titled as "Mahesh Kumar Vs. Jeet Kumar" in Eviction Petition being E. No.65/2017, whereby, Ld. Addl. Rent Controller dismissed the leave to defend application of the Petitioner and allowed the eviction petition of the Respondent;

c) Allow the present petition of the petitioner, thereby, setting aside the order dated 04.09.2019 passed by Shri Ajay Nagar, Addl. Rent Controller, West, Tis Hazari, Delhi in case titled as "Mahesh Kumar Vs. Jeet Kumar" in Eviction Petition being E. d) pass any other or further order as this Hon'ble Court may deem fit and proper under the facts and circumstances of the case." 3.

None appears on behalf of the petitioner.

There was no appearance on behalf of the petitioner on the last three dates of hearing as well, i.e., 15.09.2025, 27.01.2026 and 19.02.2026. 5.

Report with regard to the Court notice issued to the petitioner vide order dated 27.01.2026, reflects that the same has been served. 6.

Learned counsel for the respondent submits that possession of the subject premises has been taken over on 28.11.2025. 7.

In view of the above, the petition is dismissed in default for nonprosecution and disposed of accordingly. 8.
