By the present petition, the petitioner seeks quashing of the proceedings in SC No. 310/23 titled as Raj Kumar Mittal v. Rameshwar Gaur and Ors.

The said complaint was filed by Respondent No. 1 against the petitioner and other accused persons alleging offences under Sections 395/397/452 read with Sections 147/148/506 of the Indian Penal Code, 1860 ('IPC').

The petitioner also seeks initiation of proceedings against the respondent under Sections 191 to 193 of the IPC. 4.

2006 and the charges have now been framed by the learned Additional Sessions Judge by order dated 08.02.2024. 5.
Concededly, the petitioner has a remedy to challenge the order framing charge by filing a petition under Section 396/401 of the Code of Criminal Procedure, 1973.

In view of the above, the learned counsel for the petitioner seeks liberty to withdraw the present petition and take appropriate steps.

The present petition is dismissed as withdrawn with liberty to file appropriate proceedings challenging the order dated 08.02.2024.
